These Terms of Service ("Terms") govern all services provided by One Shot Drone Tours LLC ("OSDT," "we," "our") to any client ("you," "client"). Please read them carefully before booking a shoot. If you have questions, contact us at contact@oneshotdronetours.com or (704) 942-8543.
1. Acceptance of Terms
By booking a shoot through our portal, paying an invoice, or otherwise engaging our services, you agree to these Terms in full. If you do not agree, do not book or pay. Continued use of OSDT services after any update to these Terms constitutes acceptance of the revised Terms.
2. Services
OSDT provides aerial photography, drone video, FPV flythroughs, ground photography, cinematic video, and floor plan deliverables to licensed real estate agents, brokerages, and commercial clients. Standard marketing floor plans are produced using CubiCasa scanning technology. ANSI / GLA-compliant square footage reports are available as a separate add-on, ordered explicitly at booking.
The exact scope, deliverables, package, and price for any given shoot are confirmed in the booking record at the time of booking. Anything not listed in that record is out of scope.
3. Payments and Cancellations
Two booking paths are supported, each with its own payment flow:
- Online booking (self-serve). Full package fee is collected at the time of booking, before the shoot is performed.
- Direct / managed booking. No deposit is required. Full package fee is due before the client receives the final delivered media. Edited photos, video, and floor plans are released only after payment in full has been received.
Cancellations and reschedules:
- More than 24 hours before the shoot: no fee.
- Within 24 hours of the shoot: a $150 cancellation fee applies.
- Reschedules requested more than 24 hours in advance are accommodated at no charge, subject to calendar availability.
- For online (self-serve) bookings already paid in full, cancellations within 24 hours forfeit the $150 fee from the prepaid amount; the balance is refunded.
OSDT may reschedule any shoot at no penalty to the client for unsafe weather, controlled airspace closures, equipment failure, or other conditions outside our reasonable control. See Section 7 below.
4. Deliverables and Intellectual Property
OSDT retains full copyright and ownership of all photographs, video, drone footage, edited media, floor plans, graphics, and any other work product we produce ("Deliverables"). No copyright or ownership interest in any Deliverable is transferred to the client at any time.
Upon payment in full, OSDT grants the client a limited, non-exclusive, non-transferable, non-sublicensable license to use the Deliverables solely for the marketing and promotion of the specific real estate listing or commercial property they were produced for. This license includes use on MLS, the client's brokerage or business website, the client's social-media accounts, paid advertising for that listing, and printed marketing materials for that listing.
License term. For real estate listings, the license is active while the property is listed on the market. It terminates automatically when the property is sold, rented, leased, or otherwise removed from the active market. Upon termination, the client must cease all further use and distribution of the Deliverables, including any digital or print materials incorporating them. For commercial or non-listing engagements, the license term is perpetual for the specific property or project named at booking unless otherwise agreed in writing.
Restrictions. The client may not resell, sublicense, assign, gift, transfer, or otherwise grant any rights in the Deliverables to any third party without prior written consent from OSDT. The Deliverables may not be used for any property, listing, or campaign other than the one they were originally produced for. Unauthorized use, transfer, or licensing of Deliverables constitutes copyright infringement and entitles OSDT to pursue all available legal and equitable remedies.
OSDT's reserved rights. OSDT retains the irrevocable, worldwide, perpetual right to use any Deliverable in our own portfolio, marketing, social media, advertising, case studies, websites, brochures, and press materials, without further consent, notice, or compensation, unless the client requests an explicit written exclusion at the time of booking. Any such exclusion request may be subject to an additional fee.
5. Floor Plan and Square Footage
OSDT delivers two distinct floor plan products, with different intended uses and different responsibilities. Read this section carefully.
5.1 Standard floor plans (included in residential packages)
Standard floor plans are marketing visualizations. They show every room and area we are able to scan, including basements, garages, decks, porches, attics, accessory dwelling units, and other non-living or non-conditioned spaces. Standard floor plans are:
- NOT GLA-compliant and NOT ANSI Z765-compliant.
- NOT suitable for MLS square footage fields, appraisals, tax assessments, or legal documents without independent verification by a licensed appraiser, surveyor, or other qualified professional.
- Intended for marketing presentation, listing photo galleries, and visual layout only.
5.2 ANSI / GLA floor plans (ordered as a separate add-on)
When the client explicitly orders an ANSI / GLA report at booking, OSDT delivers a floor plan and square footage report produced to the ANSI Z765-2021 standard for single-family residential measurement, generated using CubiCasa's certified ANSI workflow. ANSI / GLA reports are:
- Intended for use on MLS, in listing materials, and as supporting documentation for the listed gross living area, in accordance with the ANSI Z765-2021 methodology.
- Delivered with the standard ANSI methodology disclosure and a measurement summary, so the agent or broker can comply with any MLS-specific disclosure requirements.
- Subject to all of the conditions in Section 5.3 below.
5.3 Conditions that apply to all floor plan deliverables (standard and ANSI / GLA)
- OSDT's measurement responsibility. OSDT produces floor plans using CubiCasa scanning. For standard floor plans, no measurement standard applies; they are marketing visualizations. For ANSI / GLA reports, OSDT produces the report to the ANSI Z765-2021 standard, within the rounding tolerances defined in that standard. OSDT does not warrant absolute correctness of any figure. Scanning conditions, floor obstructions, very irregular geometry, and soft furnishings can produce variation within the standard's defined tolerances. If a client identifies a measurement issue, OSDT will work in good faith to re-scan or correct the deliverable at no charge.
- Agent or broker MLS responsibility. The licensed real estate agent, broker, or other party publishing or relying on any listing, marketing material, MLS entry, or document containing OSDT-produced figures remains responsible for: (a) confirming the delivered floor plan matches the property as inspected; (b) complying with the specific MLS's rules, including any required methodology disclosure, source citation, or additional measurement notes; (c) complying with North Carolina real estate regulations, NAR guidance, and any other governing standard.
- OSDT is not the appraiser of record. OSDT measures and produces floor plans. OSDT is not a licensed appraiser, does not issue appraisals, and does not provide an opinion of value. Where an appraisal is required, the client must engage a licensed appraiser separately.
- No liability for downstream use. OSDT is not liable for any loss, claim, dispute, regulatory action, listing complaint, or damages of any kind arising from the use, publication, or republication of any square footage figure, floor plan, or measurement produced by OSDT by the client or by any third party who receives the Deliverables, directly or indirectly. The client agrees to indemnify and hold OSDT harmless from any such claims.
6. Liability, Indemnification, and On-Site Responsibilities
6.1 Liability cap
To the fullest extent permitted by law, OSDT's total aggregate liability arising out of or relating to any shoot, Deliverable, or these Terms is limited to the amount actually paid by the client for the specific shoot giving rise to the claim. This cap applies regardless of the form of action, whether in contract, tort, negligence, strict liability, or otherwise.
OSDT is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost sales, lost commissions, lost profits, loss of opportunity, lost listings, loss of business reputation, or damages of any other kind, even if OSDT has been advised of the possibility of such damages.
6.2 Property access and permissions
The client represents and warrants that, prior to each shoot, all necessary permissions, authorizations, and consents required to access the property and permit aerial and ground photography of it have been obtained, including any required HOA approvals, owner consent, tenant consent, or municipal permits. The client bears sole responsibility for ensuring OSDT's presence and operations at the property are legally authorized. OSDT shall have no obligation to verify access rights independently.
6.3 On-site safety and property condition
The client is responsible for ensuring the property is reasonably safe and accessible for OSDT personnel and equipment at the time of the shoot. The client must disclose any known hazards, unstable structures, restricted areas, or safety concerns before the shoot begins. OSDT reserves the right to terminate a shoot immediately, without refund, if on-site conditions are deemed unsafe in OSDT's sole judgment.
OSDT accepts no liability for damage to personal property, real property, or structures at or around the shoot location, nor for personal injury to any person at the property, unless caused solely by OSDT's gross negligence or willful misconduct. The client assumes all risk of pre-existing property conditions that may be captured in or affected by the shoot.
6.4 Client indemnification
The client agrees to indemnify, defend (with counsel reasonably acceptable to OSDT), and hold harmless OSDT and its members, managers, employees, contractors, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the client's use, publication, or distribution of any Deliverable; (b) the client's breach of any representation, warranty, or obligation under these Terms; (c) any claim that OSDT's access to or photography of the property was unauthorized; (d) any personal injury or property damage occurring at the shoot location that is not caused solely by OSDT's gross negligence or willful misconduct; or (e) any third-party claim arising from the client's reliance on any Deliverable or any figure derived from it.
7. Drone Operations and Weather
All drone operations are conducted under FAA Part 107 by certified remote pilots. OSDT carries $1M liability insurance. Certificates of insurance, including additional-insured endorsements, are available on request.
OSDT reserves the right, at its sole discretion, to reschedule, modify, or terminate any shoot without penalty for any of the following: unsafe weather (including rain, sustained high winds, low visibility, lightning, or precipitation), restricted or controlled airspace conditions, FAA TFRs, equipment failure, on-site safety concerns, or any other condition that would compromise the safety, legality, or quality of the work.
Where possible, weather-driven reschedules are coordinated the evening before the shoot. Any deposit already paid is applied to the rescheduled date.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or any shoot will be resolved exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and the parties consent to the personal jurisdiction of those courts.
9. Changes to Terms
OSDT may update these Terms at any time. The most current version is always posted at oneshotdronetours.com/terms. Continued use of OSDT services after any update constitutes acceptance of the revised Terms. Material changes will be reflected in the "Last updated" date below.
